Welcome to EyeSift. These Terms of Service ("Terms") govern your access to and use of the EyeSift website, platform, tools, and services (collectively, the "Service"). By accessing or using EyeSift, you agree to be bound by these Terms. If you do not agree to all of the terms and conditions set forth herein, you must not access or use the Service.

Please read these Terms carefully before using EyeSift. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and EyeSift ("we," "us," "our," or "Company"). Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the EyeSift platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy and Disclaimer, which are incorporated herein by reference. If you are using EyeSift on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" shall refer to both you individually and the organization you represent.

You must be at least 13 years of age to use EyeSift. If you are between the ages of 13 and 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using EyeSift, you represent and warrant that you meet the applicable age requirements.

2. Description of Service

EyeSift is an AI detection platform that provides tools for analyzing text, images, video, and audio content to determine the likelihood that such content was generated or manipulated by artificial intelligence. Our Service includes, but is not limited to:

  • Text Analysis: Detection of AI-generated text using perplexity scoring, burstiness analysis, and entropy measurement across models including GPT-4, Claude, Gemini, and LLaMA.
  • Image Analysis: Identification of AI-generated images through GAN fingerprint analysis, EXIF metadata examination, and compression artifact detection for generators such as Midjourney, DALL-E, and Stable Diffusion.
  • Video Analysis: Deepfake video detection using temporal consistency analysis, facial landmark tracking, and audio-visual synchronization checks.
  • Audio Analysis: AI voice clone detection through spectral analysis, prosody evaluation, and vocal tract modeling.

EyeSift provides probabilistic assessments and should be used as a supplementary tool rather than the sole basis for any decision. Our detection accuracy typically ranges from 75% to 85%, depending on the type of content analyzed and other factors. The Service is intended to assist users in making informed judgments and does not provide definitive conclusions about content authenticity.

3. User Accounts

Certain features of EyeSift may require you to create an account. When you create an account, you agree to provide accurate, current, and complete information and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify EyeSift immediately of any unauthorized use of your account or any other breach of security.

EyeSift reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. 4. Acceptable Use Policy

You agree to use EyeSift only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

  • Violate any applicable federal, state, local, or international law or regulation.
  • Upload, transmit, or distribute any content that infringes upon the intellectual property rights of any third party.
  • Harass, abuse, threaten, defame, or intimidate any individual or entity.
  • Upload any content that contains viruses, malware, or other harmful components.
  • Attempt to gain unauthorized access to EyeSift systems, servers, or networks.
  • Use automated scripts, bots, or scrapers to access or interact with the Service without express written permission.
  • Reverse engineer, decompile, or disassemble any portion of the EyeSift platform.
  • Use the Service to make false accusations against individuals based solely on EyeSift analysis results.
  • Resell, redistribute, or sublicense access to EyeSift without prior written authorization.
  • Circumvent, disable, or otherwise interfere with security-related features of the Service.

EyeSift reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including reporting violations to law enforcement authorities.

5. Intellectual Property

The EyeSift platform, including all software, algorithms, user interfaces, designs, text, graphics, logos, trademarks, and other content provided by EyeSift (collectively, "EyeSift Content"), is the exclusive property of EyeSift and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purpose, subject to these Terms.

The EyeSift name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of EyeSift. You may not use such marks without the prior written permission of EyeSift. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

6. User Content and Data

When you submit content to EyeSift for analysis, including text, images, video, and audio files ("User Content"), you retain all ownership rights to your User Content. By submitting User Content to EyeSift, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, analyze, and temporarily store your content solely for the purpose of providing the Service to you.

EyeSift processes User Content for analysis purposes only. We do not sell, share, or distribute your User Content to third parties. Content submitted for analysis is processed in real time and is not permanently stored on our servers unless you explicitly opt in to storing your analysis history. You may request deletion of any stored data at any time by contacting us at [email protected]. For more details on how we handle your data, please review our Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, EyeSift, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to, use of, or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any decisions made or actions taken based on the analysis results provided by EyeSift.

In no event shall the total liability of EyeSift to you for all claims arising out of or relating to these Terms or the Service exceed the amount you have paid to EyeSift in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater. The limitations of liability set forth in this section shall apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and even if EyeSift has been advised of the possibility of such damages.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EYESIFT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. EYESIFT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.

EYESIFT MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY ANALYSIS RESULTS PROVIDED THROUGH THE SERVICE. AI DETECTION IS PROBABILISTIC IN NATURE, AND RESULTS SHOULD NOT BE TREATED AS DEFINITIVE DETERMINATIONS. EYESIFT DOES NOT GUARANTEE THAT ITS DETECTION TOOLS WILL IDENTIFY ALL AI-GENERATED CONTENT OR THAT ALL FLAGGED CONTENT IS INDEED AI-GENERATED. YOU ACKNOWLEDGE THAT YOU USE THE SERVICE AT YOUR OWN RISK.

9. Indemnification

You agree to defend, indemnify, and hold harmless EyeSift, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; (d) any claim that your User Content caused damage to a third party; or (e) any decisions or actions you take based on analysis results provided by EyeSift.

10. Termination

EyeSift may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at [email protected]. Upon termination of your account, we will delete your account information and any stored analysis history within thirty (30) days, unless retention is required by law or for legitimate business purposes as described in our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in San Francisco County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved through informal negotiation shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in San Francisco, California. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12. Changes to Terms

EyeSift reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect by posting the updated Terms on the Service and updating the "Last Updated" date at the top of this page. We may also notify you of material changes via email if you have an account with us. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent. If such modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, and any other legal notices or policies published by EyeSift on the Service, constitute the entire agreement between you and EyeSift regarding the use of the Service. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or any other term. Any failure by EyeSift to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
